Software License & Terms of Service

1. Master Agreement & Corporate Identity

These Software License Terms of Service (“Agreement”) constitute a legally binding agreement between you (“Licensee”, “Customer”, or “You”) and FarookTech LLC, a California Limited Liability Company having its principal registered office at 1401 21ST ST STE R SACRAMENTO, CA 95811 (“FarookTech”, “Company”, “We”, or “Us”).

By purchasing, downloading, accessing, or utilizing any of our software utilities — including PulseGuard CLI & Daemon, DevVault Secrets Engine, FormFlow Relay Package, and CXONE Media Player — you expressly agree to be bound by the terms set forth herein.

2. Software License Grant & Commercial Scope

Upon payment of the applicable one-time purchase price of $9.99 USD, FarookTech LLC grants you a worldwide, non-exclusive, perpetual, non-transferable license to install, execute, and utilize the software binary, code packages, and documentation for both internal commercial business purposes and personal developer workflows.

• Commercial Rights: You may use our software tools within proprietary products, internal production clusters, and client deliverables.
• Prohibited Resale: You may not sublicense, rent, lease, redistribute, or repackage FarookTech LLC source code or binary executables as a competing standalone software product.

3. Pricing, Currency & One-Time Payment Terms

All software licenses provided by FarookTech LLC are priced at $9.99 USD per product. All pricing is strictly a one-time payment.

Zero Subscriptions: FarookTech LLC does not charge recurring monthly, annual, or maintenance fees. There are no automated renewals or hidden recurring charges. All payments are processed securely in United States Dollars (USD) via Stripe.

4. 30-Day Money-Back Guarantee & Refunds

FarookTech LLC provides an unconditional 30-Day Money-Back Guarantee on all software license purchases. If any software tool does not perform according to technical specifications or fail to meet your engineering requirements, you may request a 100% full refund within thirty (30) days of your original purchase.

5. Electronic Delivery & License Provisioning

All software products are digital goods delivered electronically. Upon confirmation of payment or invoice settlement via Stripe, your perpetual license key, download credentials, and documentation links are delivered to the recipient email address within 1–2 business hours (guaranteed under 24 hours). 6. Disclaimer of Warranties & Limitation of Liability

The software is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, statutory, or implied. FarookTech LLC does not warrant that software execution will be uninterrupted or error-free.

In no event shall FarookTech LLC, its members, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or business interruption) arising out of the use of our software. In all events, the total cumulative liability of FarookTech LLC shall not exceed the amount actually paid by you ($9.99 USD).

7. CXONE Media Player — Lawful Use & Content Policy

CXONE Media Player is a software playback engine. It does not include, provide, distribute, stream, or grant access to any media content of any kind.

• Licensee Responsibility: You are solely and exclusively responsible for ensuring that all media files you play using CXONE are owned lawfully or are used in compliance with applicable copyright and intellectual property laws in your jurisdiction.
• No DRM Circumvention: CXONE does not bypass, circumvent, remove, or disable any Digital Rights Management (DRM) system or copy protection mechanism. Use of CXONE to circumvent DRM is strictly prohibited and constitutes a material breach of this Agreement.
• No Piracy: Using CXONE to play, reproduce, or distribute unlicensed or pirated media content is strictly prohibited and may violate applicable laws including the Digital Millennium Copyright Act (DMCA) and equivalent statutes.
• Offline-Only Operation: CXONE contains no network streaming functionality. It operates exclusively with local media files stored on your device or connected storage media.

FarookTech LLC disclaims any and all liability arising from the Licensee's use of CXONE in connection with content that infringes upon the intellectual property rights of any third party.

8. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in Sacramento County, California.
